Wedding Agreement
Entire Agreement: This agreement contains the entire understanding between the Clients and the Photographer. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all the parties. If the parties want to waive one provision of this agreement that does not mean that any other provision is also waived.
Reservation: Client shall reserve the time and date of services by signing this contract along with the non-refundable $100.00 deposit. Deposit is applied towards the contracted wedding photography package. The deposit is non-refundable, even if the date is changed or if the wedding is cancelled for any reason; including acts of God, fire, strike and/or extreme weather. If the 1st date is changed to a different date, another $100.00 deposit will be required. No date is reserved until the contract is signed and deposit is received. The Client understands and agrees that the FULL amount owed for the wedding photography package chosen is due no later than 7 days prior to the wedding.
Pre-Event Consultation: The parties agree to a Pre-event consultation before the wedding date in order to finalize the actual shooting times and locations.
Cancellation/Refund Policy: In the event that the Client cancels the contracted services before the wedding ceremony takes place, Photographer will refund payment excluding non-refundable deposit. Cancellation must be made in writing and signed by the clients. . In the unlikely event that Client is completely dissatisfied with the final results based solely on personal preference, Photographer will only offer re-editing. NO Refunds will be granted after Wedding has taken place due to the Photographer already fulfilling contract duties also including travel expense, & editing time.
Cooperation: The parties agree to have cheerful cooperation and communication for the best possible Photo results. The Photographer will not be held accountable for not photographing desired people if there is no one to assist in identifying people or gathering people for photographs. The Photographer is not responsible if key individuals fail to appear or cooperate during photography sessions or for missed images due to details not revealed to the Photographer. An ‘Event Guide’ is highly recommended.
Shooting time/Additions: Shooting times start at the scheduled start time and ends at the ending time stated at the beginning of this contract. If shooting times goes over ending time; an extra fee will be added and collected before Photo CD/USB is released. Should the ceremony start late due to any reason whatsoever, the Photographer will not be held liable for any photographs not taken.
House Rules: The Photographer is limited by the guidelines of the ceremony official or reception site management. The Client agrees to accept the technical results of their imposition on the Photographer. Negotiation with the officials for moderation of guidelines is the Clients responsibility; The Photographer will offer technical recommendations only.
Guest Photography: It is understood that the NICOLE BRADLEY PHOTOGRAPHY will act as the sole and exclusive wedding photographer. Because of the fact that flashes from guest’s cameras may ruin shots taken by the Photographer and due to the time constraints and key individual’s full attention to professional photographer, it is insisted that no guest photography take place when or where the Photographer is working.
Guest Cooperation / Harassment: The Client is responsible for the conduct of their guest.
Photographer will not tolerate verbally or physically abusive behavior, nor will she share her time or compete with guest photographers for the attention of the subjects. In the event Photographer experiences any inappropriate, threatening, hostile or offensive behavior from any guest or other person at the wedding or other event (including, but not limited to, unwelcome sexual advances and verbal or physical conduct of a sexual nature) then the following process shall be followed:
First offense: a verbal warning will be issued to the Bride/Groom OR a family member of the client & the offending person will be required to leave the wedding or event;
Second offense: Photographer will end wedding coverage immediately and leave the event, Photographer shall be entitled to retain all monies paid here under and client agrees to relieve and hold Photographer harmless as a result of incomplete wedding or event photography coverage. No Refunds will be granted.
If damage is done to photographer’s equipment due to a guest, the replacement/repair cost will be absorbed by the Client. Unchecked guest conducts that interfere with photography may seriously affect the quality of the photographs taken and increase the number of times photos must be re-taken. If the Client is unable to control the conduct of their guests, resulting in an unacceptable degree of misconduct, or if the conduct of any of their guests damages the equipment of the Photographer, it will can or result in the early or immediate departure of the Photographer. The Client understands that in such an event, No Refunds will be granted.
Non-Guarantee: Although every possible care will be taken to produce photographs of all important and special events during the wedding, the Photographer cannot place an unconditional guarantee on the above. NICOLE BRADLEY PHOTOGRAPHY will not be held responsible for any ruined photographs due to guest’s flashes; or any other ruined photographs due to any other causes in or outside of Photographers control.
Meals/Breaks: A Meal is highly suggested for Photographer & Assistant Photographer for Weddings that last 5 hours or More. Dinner is required for Weddings that last 6 hours or more. A 25 Minute Break will start when Guest began eating.
Travel Expenses: If Event is scheduled outside of Photographers Local Location, Client is responsible for Photographers travel fees (I.E: Gas, Hotel (Weddings that end after 7:00 PM), Food, etc). Travel fee is non-refundable.
Photo Discs/USB/Image deletion: Upon receiving a photo CD/USB, Client accepts all responsibility for archiving and protecting the Photo CD/Images. Photographer does not permanently store image files. Photographer is not responsible for the lifespan of any digital media provided or for any future changes in digital technology or media readers that might result in an inability to read discs provided. It is Client’s responsibility to make sure that digital files are copied to new media as required. To manage storage, Once Client receives Photo CD/USB, Photographer will delete all images, edited & unedited. A copy of the CD/USB images will be held for 1 year from Wedding date. After 1 year, it will be deleted. No Raw Images will ever be released.
Model Release: The Client hereby grants to Photographer and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of the Client or in which the Client may be included, for editorial, trade, advertising and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The Client hereby releases NICOLE BRADLEY and its legal representatives and assigns from all claims and liability relating to said photographs.
Copyright: Until Final Payment for services rendered is made, the photographs produced by NICOLE BRADLEY PHOTOGRAPHY are protected by Copyright Law and may not be reproduced in any manner without Photographers explicit written permission. Until final payment by the Client, limited copyright ownership of the resulting images will be transferred to the Client under the following condition: The resulting images are for personal use and for the purposes of the reproduction and distribution of photographs to friends and relatives.
Limited to Liability: In the unlikely event that the Photographer is injured or becomes too ill to photograph the event, The Photographer will make effort to secure a replacement photographer. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event package. The photographer takes the utmost care with respect to exposure, transportation, and processing the photographs. However, in the unlikely event that photographs have been lost, stolen, destroyed for reasons within or beyond the Photographer’s control before the Photo CD/USB is released to Client, the photographer is liability is limited to return of all payments, excluding non-refundable deposit, received for the event package.
