SPORTS TEAM PORTRAIT AGREEMENT
This document is a contractual agreement made between:

AGREEMENT TERMS
PORTRAIT SESSION: TEAM is guaranteed up to 45 Minutes to One hour of shoot time. Each individual image is chosen based on quality of the images (I.E: based on Photo Clarity, no interference, opened eyes, correct exposure, Cooperation of Client or Key individuals, etc…). Photographer retains the right to edit the photographs and omit any image. Photo editing & Printing Time will take 2 Weeks. Photographer is not responsible for incorrect information.
PACKAGE: Team package includes Prints. Photos are printed at an Online Printing lab. Prints will be individually package and labeled with individuals name.
COACH: Head Coach OR Client responsible of booking Session will receive One 5×7 Team Portrait UPON REQUEST before Session is over. This option will not be available once Session is over. Coach is responsible in supplying a Team Roster to Photographer before the Session starts (Preferably the day before).
METHOD OF PAYMENT: Cash only. Payment is due at the time of session. NO CHECKS.
REFUNDS/RETAKES: Session/Sales are Final. Due to the amount of time, printing cost and photographer fulfillment of duties, NO refund will be given. Session is FINAL. No retakes will be offered. It is suggested all Team Members be present and ready at the time of session. Photographer is not responsible for any missed Members.
TRAVEL FEE: If Session is scheduled outside of Photographers Local Locations, Client is responsible for Photographers travel fees (I.E: Gas Mileage, Hotel, Food, etc). Travel Fees are non-refundable.
GUEST PHOTOGRAPHY: To ensure that Team members receive high quality photos, No Guest Photography is permitted, unless members obtain permission by photographer. Nicole Bradley will act as the main photographer for the duration of the scheduled photo session. Nicole Bradley has the right to bring an assistant at her discretion. It is requested that only members and/or Key individuals be in attendance and Parent/Guardians present if members are underaged. All guest camera flashes must be turned off. Photographer is not responsible for lost images due to Guest interferences. Due to the time constraint, full attention of each Member is requested for the scheduled session.
COPYRIGHT: All photos are copyrighted to and remain the property of Nicole Bradley. Photos may NOT be edited, cropped, enhanced, written across, decorated, photoshopped, or otherwise altered in anyway.
TEAM MEMBERS USAGE; Team are obtaining prints for personal use only, and shall not sell said photographs or authorize any reproductions by parties other than Photographer. Photographs for publication (such as editorial, public relations or advertising use) require prior consent from Photographer. A credit line which reads “Nicole Bradley Photography” in type no smaller than that of the related text must appear adjacent to or within all permitted published photographs.
PRINTS / DELIVERY/ INFO: Upon receiving PRINTS, Team members accept all responsibility for archiving and protecting the photographs. Photographer does not permanently store image files. Upon receiving Prints, Team Parents & Members accept all responsibility for protecting prints. Team COACH listed above will be responsible in distributing all prints to the correct individual. Photographer is NOT responsible for Prints after being released to Team COACH signed above. To manage storage, once Prints are released, Photographer will delete all images, edited & unedited. A copy of the Team images (photos given to individuals) will be held for 1 year from Session date. After 1 year, it will be deleted. No Raw Images will ever be released.
MODEL RELEASE (optional): Team COACH and Team grants Photographer and her legal representatives and assigns, their revocable and unrestricted right to use and publish photographs of Team. Team members may be included for editorial, trade, advertising and other purposes, and in any other manner and medium; to alter the same without restriction; and to copyright the same. Team Coach and members hereby release Photographer and her legal representatives and assigns from all claims and liability relating to said photographs.
LIMIT OF LIABILITY: We take the utmost care with respect to the exposure, retouching, and transportation of the digital images. However, in the unlikely event that all the originals are lost, stolen, damaged or destroyed within or beyond Photographer’s control, Photographer’s liability is limited to the refund of all payments received, or a reshoot can be rescheduled at no additional cost. The limit of liability for partial loss or damage of originals shall be a prorated amount of the total amount, based on the percentage of originals lost or damaged. In the unlikely event that Photographer is injured or becomes too ill to attend the portrait session, Photographer will make every effort to reschedule to the earliest possible date. If session cannot be rescheduled, responsibility and liability is limited to the return of all payments received.
ENTIRE AGREEMENT: This agreement contains the entire understanding between Photographer and Team Coach and Team. It supersedes all prior agreements between the parties. The only way to add or change this agreement is in writing, signed by Photographer and Team Coach. If the parties want to waive one provision of this agreement, it does not mean that any other provision is also waived. This constitutes an order for one portrait session with Nicole Bradley.
I have read and understood the terms of this agreement. I hereby agree to all the terms of the agreement.
_________ I hereby give NICOLE BRADLEY PHOTOGRAPHY the right to use the photos, without any restriction as to change or alterations, to be uploaded on the NICOLE BRADLEY PHOTOGRAPHY website and Social Media (Facebook). I agree that NICOLE BRADLEY PHOTOGRAPHY may also use my photos for advertising and portfolio purposes. NO NAME OR PERSONAL INFORMATION WILL BE RELEASED.
