PORTRAIT AGREEMENT
This document is a contractual agreement made between Nicolette Bradley aka Nicole Bradley (referred to hereafter as “Photographer”) @ Nicole_bradley_photography@yahoo.com.

AGREEMENT TERMS
PORTRAIT SESSION: Client is guaranteed up to one hour of shoot time. Mini Sessions are guaranteed up to 15-25 Minutes of shoot time. The top images are chosen based on quality of the images (I.E: based on Photo Clarity, no interference, opened eyes, correct exposure, Cooperation of Client or Key individuals, etc…). Photographer retains the right to edit the photographs and omit any image. Photo editing will take 1 week (7 days) unless informed otherwise. All photo CDs will be mailed, unless a meeting agreement is made. It is Clients responsibility that mailing address above is correct. Photographer is not responsible for incorrect information. Nicole Bradley is NOT responsible for any injuries that may occur at Sessions to Client & Client guest. Nicole Bradley is NOT responsible for any damages that may occur to Client’s Clothes, Jewelry, Vehicle, etc.
METHOD OF PAYMENT: *CASH ONLY*. Payment is due at the time of session. Full amount is required at the time of session unless Client and Photographer have a payment plan agreement. It is requested that client brings correct amount, Photographer may not always have change. No checks will be accepted. In the unlikely event that a local check is received, if check is returned as bad or insufficient funds, Photo CD will not be released, and Client is responsible for Session payment and for additional $40.00 in bank fees. PHOTO CD WILL NOT BE RELEASED UNTIL FULL PAYMENT IS PAID.
CANCELLATION/POSTPONEMENT: Client understands that by entering into this agreement, Photographer is foregoing other photographic jobs. 24-48 hour or more notice of postponements or cancellations is appreciated.
WEATHER: If it is not possible for a session to take place on a scheduled day due to weather, Photographer and Client will reschedule on an agreed date at the earliest date possible, with no additional charge.
COOPERATION/ LATENESS/ NO SHOWS/RESCHEDULING: Photographer is not responsible if Client and/or key individuals fail to appear or cooperate during portrait sessions, or for missed images due to details not revealed to Photographer. If Client and/or key individuals fail to appear to a scheduled session, a $25.00 non-refundable fee will be charged. The session can be rescheduled at the original portrait session fee but will require a $25.00 non-refundable deposit. More than ONE No Show or Last-Minute Cancellations will result in Photographer no longer being able to work with Client. Photographer will WAIT UP TO 10 MINUTES AFTER THE SCHEDULED TIME, if client fails to appear or notify the photographer, Photographer has the right to leave. Max time Photographer will wait is no more than 20 Minutes, even if Client has notified the Photographer. If Client is more than 20 minutes late, Photographer will have the right to leave, and Client will have to make another appointment AND an additional $25 fee will be added to the next appointment. Only 1 Reschedule will be allowed per month. More than 2 Reschedules in a short time span will result in Photographer not being able to work with Client.
RESHOOTS/REFUNDS: In the unlikely event that Client is completely dissatisfied with the final results; Problems with Outfit, Hair, or Facial emotions such as no smile and/or no cooperation from key individual DOES NOT qualify for a Reshoot/Refund/Re-Edit. Photographer will reshoot at no cost. 1st Photo CD must be returned. In the unlikely event that the finished product from a portrait session is unusable due to technical problems, (camera failure or exposure problems), Photographer will reshoot at no additional charge. Photographer has the right to reschedule due to illness, emergency, weather, accident, car trouble, death of a family member, and family emergency, etc. Due to Photographer fulfilling contract duties, travel expenses, and editing time; No refund will be granted. Photographer will offer a reshoot or re-editing.
GUEST PHOTOGRAPHY: To ensure that client receives high quality photos, No Guest Photography is permitted, unless client obtains permission by photographer. Nicole Bradley will act as the main photographer for the duration of the scheduled photo session. Nicole Bradley has the right to bring an assistant at her discretion. It is requested that only Client and/or Key individuals be in attendance and Parent/Guardians present if client is underaged. All guest camera flashes must be turned off. Photographer is not responsible for lost images due to Guest interferences. Due to the time constraint, full attention of the client is requested for the scheduled session.
TRAVEL EXPENSES: If Session is scheduled outside of Photographers Local Locations, Client is responsible for Photographers travel fees (I.E: Gas Mileage, Hotel, Food, etc). Travel Fees are non-refundable.
COPYRIGHT: All images are copyrighted to and remain the property of Nicole Bradley. Images may NOT be edited, cropped, enhanced, written across, decorated, photoshopped, or otherwise altered in anyway.
CLIENT’S USAGE: Client is obtaining images for personal use only and shall not sell said photographs or authorize any reproductions by parties other than Photographer. Photographs for publication (such as editorial, public relations or advertising use) require prior written consent from Photographer. A credit line which reads “Nicole Bradley” in type no smaller than that of the related text must appear adjacent to or within all permitted published photographs.
PHOTO DISC/IMAGE DELETION: Upon receiving a photo CD, Client accepts all responsibility for archiving and protecting the Photo CD/Images. Photographer does not permanently store image files. Photographer is not responsible for the lifespan of any digital media provided or for any future changes in digital technology or media readers that might result in an inability to read discs provided. It is Client’s responsibility to make sure that digital files are copied to new media as required. To manage storage, Once Client receives Photo CD, Photographer will delete all images, edited & unedited. A copy of the CD images will be held for 1 year from Session date. After 1 year, it will be deleted. No Raw Images will ever be released.
PHOTO CD MEET UP: If Client chooses to meet for their Photo CD rather than have mailed, Photographer and Client will agree on a meeting place. Photographer will wait no more than 10 minutes. If Client does not show within 10 minutes, Photographer will have the right to leave and Photo CD will be mailed even if Client informed of being late.
MODEL RELEASE (optional): Client grants to Photographer and her legal representatives and assigns, their revocable and unrestricted right to use and publish photographs of Client, Client’s child or children, or in which Client may be included for editorial, trade, advertising and other purposes, and in any other manner and medium; to alter the same without restriction; and to copyright the same. Client hereby releases Photographer and her legal representatives and assigns from all claims and liability relating to said photographs.
LIMIT OF LIABILITY: We take the utmost care with respect to the exposure, retouching, and transportation of the digital images. However, in the unlikely event that all the originals are lost, stolen, damaged or destroyed within or beyond Photographer’s control before Client receives Photo CD, Photographer’s liability is limited to the refund of all payments received, or a reshoot can be rescheduled at no additional cost. The limit of liability for partial loss or damage of originals shall be a prorated amount of the total amount, based on the percentage of originals lost or damaged. In the unlikely event that Photographer is injured or becomes too ill to attend the portrait session, Photographer will make every effort to reschedule to the earliest possible date available. If session cannot be rescheduled, responsibility and liability is limited to the return of any payments received prior to the Session.
ENTIRE AGREEMENT: This agreement contains the entire understanding between Photographer and Client. It supersedes all prior agreements between the parties. The only way to add or change this agreement is in writing, signed by Photographer and Client. If the parties want to waive one provision of this agreement, it does not mean that any other provision is also waived. This constitutes an order for one portrait session with Nicole Bradley.
I have read and understood the terms of this agreement. I hereby agree to all the terms of the agreement.
_________ (Initials) I hereby give NICOLE BRADLEY Permission to use my photos, without any restriction as to change or alterations, to be uploaded on the NICOLE BRADLEY PHOTOGRAPHY website and Social Media (Facebook and Instagram). I agree that NICOLE BRADLEY PHOTOGRAPHY may also use my photos for advertising and portfolio purposes. NO NAME OR PERSONAL INFORMATION WILL BE RELEASED.
